BoxMaxxing Terms of Use

📜 1. Agreement

These Terms are a binding agreement between you and METATENSOR PTY LTD ("Metatensor", "we", "us"), North Tce, Adelaide SA 5000, Australia, covering the BoxMaxxing app and related services (the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy.

If you downloaded BoxMaxxing from the Apple App Store or Google Play, the store's own terms also apply. Apple and Google are not responsible for the Service, its maintenance, or support, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

You must be at least 16 years old to use the Service.

🩺 2. Health & Safety — Read This

Training plans are generated automatically from the information you provide. Their quality depends on the accuracy of that information, and they may not account for every individual condition. Use your judgment; if a movement feels wrong for your body, skip it.

👤 3. Your Account & Identity

• Keep your account credentials secure; you are responsible for activity under your account.
• Fighter names and any other content you submit must not be offensive, misleading, infringing, or promotional. We may filter, reset, or refuse names and content that break this rule.
• You grant us a non-exclusive, worldwide license to display your fighter name, avatar, and game statistics inside the Service (for example on leaderboards) for as long as you use it.

💳 4. Subscriptions, Trials & Billing

• BoxMaxxing Pro is an auto-renewing subscription (e.g. weekly, 6-month, or annual) purchased through the Apple App Store or Google Play. Prices are shown in the app before purchase.
• Free trials convert automatically to a paid subscription unless cancelled at least 24 hours before the trial ends.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your App Store / Google Play subscription settings — deleting the app does not cancel a subscription.
• Refunds are handled by Apple or Google under their store policies. Nothing in these Terms limits any non-excludable statutory refund rights you hold.
• We may change prices for future periods with reasonable advance notice; changes never apply retroactively.

🎮 5. Fair Play & Acceptable Use

You agree not to:

• cheat, automate, falsify, or manipulate workouts, scores, streaks, or league standings, or interfere with other users' rankings;
• access the Service by any means other than the official app, probe or disrupt our systems, or circumvent technical or rate limits;
• copy, extract, scrape, decompile, or redistribute any part of the Service — including its training content, 3D characters, animations, audio, and software;
• use the Service for anything unlawful, or harass or harm other users.

We may remove scores or content, suspend, or terminate accounts that break these rules, and we may keep competition data accurate by removing falsified entries.

🧠 6. Our Content & License

We grant you a personal, non-transferable, revocable license to use the app on devices you own for your personal fitness. The Service — including all software, coaching content, exercise programs, 3D characters and animations, branding, and design — is owned by Metatensor or its licensors and protected by intellectual-property laws. No rights are granted except as stated in these Terms.

Community features may include system-generated training partners to keep new leagues active; league content and rankings are provided for motivation and entertainment.

⚠️ 7. Disclaimers & Liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right you have under the Australian Consumer Law or any other law that cannot be excluded. Subject to that:

• the Service is provided "as is" and "as available"; we do not guarantee uninterrupted or error-free operation, or that any fitness outcome will be achieved;
• to the maximum extent permitted by law, Metatensor is not liable for indirect, incidental, or consequential loss, or for personal injury arising from your voluntary participation in physical exercise;
• to the maximum extent permitted by law, our total aggregate liability relating to the Service is limited to the amount you paid us in the 12 months before the claim (or, where a consumer guarantee applies, to re-supplying the Service or paying the cost of re-supply).

You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Service, to the extent permitted by law.

🧾 8. Termination, Changes & Governing Law

• You may stop using the Service and delete your account at any time in Settings.
• We may suspend or terminate access for breach of these Terms, unlawful conduct, or where required to protect the Service or other users. Sections 2, 5, 6, 7 and 8 survive termination.
• We may update these Terms as the Service evolves; material changes will be flagged in the app, and continued use after the effective date is acceptance.
• These Terms are governed by the laws of South Australia, Australia, and disputes are subject to the non-exclusive jurisdiction of the courts of South Australia — without limiting any mandatory consumer protections in your country of residence.
